国刑法修正案（十一）》正式施行，其中将“危险作业罪”纳入刑法范围引人注意。这意味着，企业必须高度重视安全工作，否则即使不发生火灾事故也可能被追究刑事责任。刑法修正案中“危险作业罪”涉及 三种情形 ：<br style="box-sizing: border-box;"/></p><p style="white-space: normal;margin: 0px;padding: 0px;box-sizing: border-box;"><br style="box-sizing: border-box;"/></p><p style="white-space: normal;margin: 0px;padding: 0px;box-sizing: border-box;">（一）关闭、破坏直接关系生产安全的监控、报警、防护、救生设备、设施， 或者篡改、隐瞒、销毁其相关数据、信息的；</p><p style="white-space: normal;margin: 0px;padding: 0px;box-sizing: border-box;"><br style="box-sizing: border-box;"/></p><p style="white-space: normal;margin: 0px;padding: border-box;">上述三条规定都强调了在安全生产领域即使未发生重大伤亡事故，但只要行为人的行为导致具有发生重大伤亡事故或者其他严重后果的现实危险，就会受到刑法的规制，行为人将被追究刑事责任，在实际生产生活中，如在有火灾风险隐患的生产环境中擅自停用消防设施的行为将极大增加发生火灾亡人事故的现实危险，因此，消防设施是直接关系生产安全的监控、报警、防护的重要防护设施，不得关闭和破坏，否则将面临刑事处罚。</p></section></section></section><section
